Terms of Service
These terms cover using nocturne.design and working with NOCTURNE. By using the site or sending us a request, you agree to them.
What we do
NOCTURNE designs and builds websites, scroll films, local SEO pages and Google Business profiles for businesses. The specific scope, price and timeline for your project are confirmed with you in writing (a message, quote or invoice) before paid work begins. If that written confirmation conflicts with these terms, the written confirmation controls for that project.
The demo
- The demo is one real page for your business on a live link, usually within 24 hours of getting the info we need (business name, service area, and any photos or details you want included).
- Free demo: free after a short call (about 10 minutes) so we can build it around your business. There's no charge and no obligation.
- $50 demo: if you'd rather skip the call, the demo is $50. If you move forward with Launch or Signature, the $50 is credited toward that price. Once the demo is delivered, the $50 is non-refundable. If we can't deliver a demo for any reason, we'll refund it in full.
- Either way, you're free to keep the demo page we deliver. It doesn't obligate you to anything else.
Projects and timelines
Launch (starting at $1,500) and Signature (custom-quoted) are priced as confirmed with you in writing before paid work begins. Listed timelines (about 5 days for Launch, 10 for Signature) start once we have your approval, payment and the content we need from you. They're good-faith targets, not guarantees. Delays in receiving your content, feedback or access push the timeline back. Prices on the site may change, but never for a project you've already confirmed.
Payment
Payment is due as stated in your quote or invoice. We may pause work or hold launch until invoices are paid. Unless we agree otherwise in writing, there are no annual contracts.
Your content
You're responsible for the logos, photos, text and other material you give us. You confirm you have the right to use it, and you give us permission to use it to build and promote your project. Please don't send anything you don't own or have permission to use.
Who owns what
Once you've paid in full, you own the final website and the deliverables we create specifically for you, and we'll hand over the files on request. Third-party pieces such as fonts, code libraries, stock media, plugins and hosting or platform services stay under their own licenses and terms. We keep ownership of our general know-how, tools and reusable code, and grant you the right to use them as part of your site.
Showing our work
We may show the work we do for you (screens, videos, links) in our portfolio and marketing, unless you ask us not to in writing.
Third-party costs and services
Domain registration, paid hosting plans, premium plugins, stock media and other third-party services aren't included unless your quote says so. They're governed by those providers' terms, and we aren't responsible for their outages, price changes or policies.
No guaranteed results
We build to get you found and get you called, but we can't guarantee search rankings, traffic, calls, leads or revenue. Google and other platforms control their own results. The missed-call calculator on our site is an illustrative estimate based only on the numbers you enter. It isn't a promise or a prediction.
Using this site
Don't misuse the site: no attempts to break it, overload it, scrape it at scale, or send spam or harmful content through the form. The site's design, code, videos and text belong to NOCTURNE or our clients and may not be copied without permission.
Disclaimers and liability
The site and our services are provided "as is," to the fullest extent the law allows. To the extent permitted by law, NOCTURNE won't be liable for indirect, incidental or consequential damages such as lost profits or lost data. Our total liability for any claim related to a project is limited to the amount you paid us for that project in the 12 months before the claim.
Governing law
These terms are governed by the laws of the State of California. Any dispute will be handled in the state or federal courts located in Los Angeles County, California, and you and we both consent to that.
Changes
We may update these terms. The effective date at the top shows the latest version. Confirmed projects stay under the terms in place when you confirmed them unless we both agree otherwise.
